Certainly. One of the first crucial steps is determining whether probate is even necessary. Probate is a legal process for administering a deceased person’s estate. Not all estates require it, thankfully.
We start by evaluating the value of the estate. In California, if the gross value of the estate is below $184,500, probate may be avoidable. This threshold can change, so it’s always best to consult with an attorney for the most up-to-date information.
Moreover, we identify any assets that are not subject to probate. These are often referred to as “non-probate assets.” Common examples include assets held in a trust, property owned jointly with right of survivorship, and certain retirement accounts with designated beneficiaries. If a significant portion of the estate falls under these categories, probate may be unnecessary.
Conversely, if the estate exceeds the threshold or primarily consists of assets subject to probate, then we would proceed with filing a petition for probate in the appropriate county court.

Steve Bliss:
Well, sometimes people underestimate the value of their assets or forget about certain accounts. It’s understandable; life gets busy. I recall one instance where a client thought their estate was well below the threshold, only to discover they had forgotten about a sizable retirement account. Consequently, we needed to proceed with probate.
On a positive note, it’s incredibly rewarding when we can help families avoid probate altogether. For example, I recently worked with a couple who had diligently set up a revocable living trust. Because of their foresight, their heirs were able to inherit their assets smoothly and efficiently without the need for court intervention.
