One step that often gets overlooked but is absolutely vital is naming beneficiaries. It seems straightforward, but clearly identifying who inherits what can prevent future confusion and potential disputes among family members.
Think of it as building a roadmap for your assets. You wouldn’t embark on a journey without a clear destination in mind, would you? Similarly, specifying beneficiaries ensures your wishes are honored and your loved ones receive the intended support.
Moreover, this step goes beyond simply listing names. It involves considering various factors like age, financial situation, and even potential future needs of your beneficiaries. For instance, if you have young children, establishing a trust for their inheritance might be wise to ensure responsible management of those funds until they reach maturity.
It’s not uncommon for me to encounter situations where clients assumed their assets would automatically go to their closest relatives. Consequently, they were surprised to learn that intestate succession laws dictate asset distribution if no will or trust exists. This can lead to unintended consequences and potentially strain family relationships.

Have you encountered any challenges related to naming beneficiaries during your career?

I recall one instance where a client wanted to leave a portion of their estate to a charity close to their heart. However, they hadn’t discussed this with their family beforehand. This led to some initial apprehension from their children, who understandably wondered why their inheritance was being partially allocated elsewhere.
We were able to navigate this situation by having an open and honest conversation with the entire family. Ultimately, understanding the client’s deep-seated passion for the charity helped alleviate concerns and fostered a sense of shared purpose.
What advice would you give readers about ensuring their estate plan reflects their current wishes?

Life is constantly evolving, and so are our priorities. Accordingly, I recommend reviewing your estate plan every 3-5 years, or sooner if you experience significant life events like marriage, divorce, the birth of a child, or the passing of a loved one. This ensures your plan remains aligned with your current circumstances and aspirations.
According to a study by Caring.com, over 60% of Americans don’t have an updated will. This can lead to significant complications for loved ones during an already difficult time.
