“This is a vital part of the guardianship journey. The court appoints an investigator, sometimes called a guardian ad litem, who acts independently to assess the situation objectively. They’ll interview the proposed ward, visit their living environment, and gather input from family members, caregivers, and professionals involved in the individual’s care.”
He continues passionately.
“The investigator often requests a medical or psychological evaluation to get a clear understanding of the ward’s decision-making capacity. Think of it as gathering all the pieces of the puzzle before making a final judgment. The investigator then compiles a detailed report, which is submitted to the court for review.”
Have there been any challenging situations during this investigation phase that stand out in your mind?

“Well, one case involved an elderly gentleman who was fiercely independent but struggling with memory issues. His family was concerned and wanted to establish guardianship. During the investigation, it turned out that he had hidden a significant amount of cash in his house – something he hadn’t disclosed to anyone! It added an unexpected layer to the process, requiring us to work closely with financial advisors and ensure the funds were managed responsibly.”
