A trust allows assets to pass directly to beneficiaries without going through probate court. Trusts also offer privacy because they are not public records like wills.”
Focus on Irrevocable Trusts
Today we’ll be focusing on irrevocable trusts. Could you shed some light on what makes these unique and when someone might choose this type of trust?
“Irrevocable trusts, as the name suggests, cannot be easily changed or dissolved once they are established,” Steve clarifies. “This permanence offers several key advantages.”
He goes on to explain, “Firstly, assets placed in an irrevocable trust are typically removed from the grantor’s taxable estate, which can significantly reduce estate taxes. Secondly, irrevocable trusts can be powerful tools for asset protection. Since the grantor no longer owns the assets, they are shielded from creditors and potential lawsuits.”
“However,” Steve cautions, “it’s important to understand that relinquishing control over assets is a significant decision. Once placed in an irrevocable trust, the grantor generally cannot access those funds or make changes to the trust terms without the consent of the beneficiaries.”
Navigating Complexities
That brings up an important point. Have you ever encountered any challenges or unique situations when setting up irrevocable trusts for clients?
Steve leans forward thoughtfully. “Certainly. One instance that comes to mind involved a client who was concerned about protecting their family business from potential liabilities. We crafted an irrevocable trust that held the business assets, shielding them from personal lawsuits against the owner. This provided peace of mind and ensured the continuity of the family business for future generations.”
“Another time,” Steve continues, “I worked with a couple who wanted to ensure their daughter with special needs would be financially secure without jeopardizing her eligibility for government benefits. We established a Special Needs Trust, funded with assets from their estate. This trust allowed their daughter to receive supplemental support while preserving her access to essential programs.”
According to a 2021 study by the American College of Trust and Estate Counsel, approximately 65% of high-net-worth individuals utilize trusts for asset protection and estate planning purposes.
